Oklahoma ends EVV exemption for live-ins

Oklahoma is ending its longstanding exemption that allowed live-in caregivers to avoid Electronic Visit Verification requirements. The change aligns the state with updated federal guidance and will bring live-in services under full EVV tracking.

The Oklahoma Department of Human Services confirmed that agencies will be required to begin capturing EVV data for live-in arrangements as part of a phased rollout expected to begin in 2026. The state will publish additional training, timelines and technical guidance as implementation approaches.

For IDD and HCBS providers, the end of the exemption means workflows will need to change. Agencies should expect new time-tracking processes, system updates and added training for staff who have not previously used EVV tools. Providers relying heavily on live-in staffing models may see increased administrative steps as EVV becomes mandatory across personal care and habilitation services.

Preparing early, reviewing documentation practices, and ensuring caregivers have access to the right technology will help minimize disruption once Oklahoma finalizes its implementation plan.
